Because of the high level of public interest in the Deepwater Horizon oil spill and the significant amount of litigation it is expected to generate, it is important that all LSU employees involved in the response to the spill comply with the requirements of the Louisiana Public Records Law and LSU policy on maintaining and archiving public records. All data, e-mails, correspondence, electronic documents, paper documents, logs, and any other record of any sort must be maintained by the LSU employee who generated it, or his or her department. State law prohibits the destruction of any public record for a period of 3 years from its creation. In addition to being required by law, preservation of these records will enable the university to better evaluate its overall response to the spill and to preserve for historians contemporaneous records of the state’s response to the spill. Reliance on exceptions to the Public Records law will be evaluated by legal counsel on a case-by-case basis, but the record retention policy should be strictly followed.
